The deadline rules, permanently
| Who you are | Your last day to file |
|---|---|
| Self lodger (myTax or paper) | 31 October after the financial year ends 30 June, or the next business day if it falls on a weekend |
| Tax agent client, on their books by 31 October | Your agent's program date, commonly up to 15 May the following year |
| Signed with an agent after 31 October | Technically already overdue, but the agent lodges and argues leniency |
| ATO has issued a specific due date or demand | The date on that notice overrides everything |
| Previous years never lodged | Those deadlines have passed and consequences accrue daily |

Why 31 October matters twice
It is not only the lodgment deadline, it is also the cut-off to buy the extension. The agent program's May dates only attach to clients on an agent's list by 31 October. This is the cheapest deadline insurance in Australian tax: engaging an agent in October costs nothing extra and buys most people six and a half months. Engaging one on 1 November buys expertise and advocacy, but not the automatic extension.
Missed it? The honest damage report
- Refund owed (most employees): in practice usually no penalty. Your refund is waiting, whole, and the only person you are penalising by waiting is you.
- Tax owing: the failure to lodge clock runs at $364 for each 28 days late, capped at $1,820 per return, and interest accrues on the unpaid tax from its due date. Both are routinely remitted for first timers who lodge voluntarily.
- Serial non-lodger: each unlodged year stacks its own penalty cap, refunds sit frozen, and the endpoint is a default assessment, the ATO's inflated estimate plus 75%.
The universal rule: every consequence above is graded by how you come back, not only how late you are. Voluntary beats chased, always. The complete recovery sequence is in the overdue tax returns guide.
Deadlines the 31 October rule doesn't cover
Do not map the October date onto everything. BAS runs quarterly on the 28ths, paying a tax bill has its own due date (generally 21 November for on-time self lodgers), and amendment windows run two years from your notice of assessment.
