ATO late lodgement penalty: up to $364 per 28 days, capped at $1,820 per document · interest 11.43% p.a. compounding daily · See how to remit them →
That's the short answer. Here's the honest, detailed one, including the step-by-step way out.
First: you're not going to jail, and you're not alone
Hundreds of thousands of Australians have at least one overdue return. Five years of unlodged returns is common enough that the ATO has a standard process for it, and that process is designed to get you lodging again, not to punish you into hiding for another five years.
Prosecution for non-lodgment exists, but it's reserved for people who ignore repeated formal demands, usually with large amounts of tax at stake. If you come forward before the ATO comes to you, prosecution is effectively off the table. See can you go to jail for not lodging tax returns for the detail.
What the ATO can do about 5 years of missed returns
| ATO action | What it means | Likely if you catch up voluntarily |
|---|---|---|
| Failure to lodge (FTL) penalty | Up to $1,820 per overdue return (5 penalty units at $364) | Often reduced or remitted, especially for a first offence or where refunds are due |
| General interest charge (GIC) | Daily compounding interest, currently 11.43% p.a., on any tax you owed | Applies to tax debts, but can be partially remitted with a good case |
| Default assessment | The ATO estimates your income and taxes you on the estimate, usually in its favour | Rare if you lodge before the ATO escalates |
| Withheld refunds and offsets | Refunds and some government payments can be held until you lodge | Resolved as soon as the returns go in |
| Prosecution | Court action for continued refusal after formal demands | Very unlikely where there is a voluntary disclosure |
How far back can you lodge? All of it
There's no time limit on lodging overdue returns. Whether it's 5, 10 or 20 years, every outstanding return can still be lodged, and any refunds from those years are still payable to you. The obligation never expires, but neither does your refund. Our guide on how many years back you can lodge covers the mechanics.
Your 5-step catch-up plan
Catching up five years of returns
Find out exactly what's outstanding
Log in to ATO online services via myGov and check your lodgment status, or have a registered tax agent pull your record in minutes. You may find years the ATO doesn't actually require.
Check which years actually need a return
If your income in a given year was under the tax-free threshold, or was only certain government payments, you may only need to submit a non-lodgment advice for that year. This alone can shrink five years of returns into two or three.
Reconstruct your income
The ATO already holds pre-fill data covering salaries, bank interest, dividends and private health details going back many years. A tax agent can access it, so lost payslips usually don't matter.
Lodge oldest to newest
Lodging in order lets losses, offsets and study loan balances carry forward correctly. A registered agent can lodge prior-year returns electronically, while myTax only supports a limited number of past years.
Deal with any debt before it deals with you
If the returns produce a tax bill you can't pay at once, set up an ATO payment plan immediately. Penalties and interest are far easier to have remitted when you're engaging rather than avoiding.
For the payment side, see our guide to ATO payment plans, and for the penalties, our penalty remission request template.
What will 5 years of late returns actually cost?
| Scenario | Likely outcome |
|---|---|
| Employee, PAYG withheld all 5 years, refunds due | No penalties in most cases. Refunds for all five years paid, often several thousand dollars in total. |
| Mixed years, some refunds and some small debts | FTL penalties possible on the debt years, frequently remitted for a voluntary disclosure, plus GIC on the debt amounts. |
| Sole trader with untaxed income all 5 years | Tax owing plus GIC and likely FTL penalties. Still far better handled voluntarily, with remission and payment plans available. |
