What failure actually costs
FBT at 47% on the grossed-up value, typically $5,000 to $9,000 or more per vehicle per year under the statutory formula on a $60,000 ute. Reviews assess back years, because the ATO cross-matches motor registry records against employers with no FBT lodgments. Multiply that across a small fleet and "the utes are exempt" becomes the most expensive sentence in the business. For owner-directors, the personal ute on the company's books is the same exposure pointed at yourself.
Running it properly
A written private-use policy that employees acknowledge.
Odometer records or telematics that could evidence the safe-harbour kilometres.
Dual cab payload specifications on file for limb one.
Where real private use exists, either an employee contribution arrangement that reduces the taxable value to nil, which is the clean fix, or FBT returns lodged and the cost priced against simply paying more salary.
Only eligible commercial vehicles with genuinely limited private use. The exemption has two limbs and most casual arrangements fail the second.
How much private use is allowed FBT-free?
The ATO's safe harbour is home to work travel plus other private use under about 1,000km a year, with no single return trip over 200km and only minor diversions.
Do dual cab utes qualify?
Only where the payload and design maths makes them non-passenger vehicles. Many family-oriented dual cabs do not, failing before private use is even considered.
What if my employees use utes privately?
Value the benefit using the statutory or logbook method and lodge FBT, or have employees contribute the private use cost, which can reduce the taxable value to nil.
Can the ATO find undeclared ute benefits?
Yes. Motor registry data matching against FBT lodgment records is a standing program, and voluntary disclosure prices far better than discovery.
